6. The health and safety committee or, if there is no committee, the safety representative and the employer shall classify the instruments and apparatus needed by a safety representative to exercise his functions in an establishment into one of the following categories:
(1)  the instruments and apparatus whose availability at all times in the establishment must be ensured by the employer unless he is prevented from doing so for reasons beyond his control; or
(2)  the instruments and apparatus whose availability in the establishment must be ensured by the employer within 48 hours after the safety representative sends a notice to that effect. An employer who cannot follow up the notice within the time allowed must immediately advise the safety representative thereof.
